PARTICIPATION CONSTITUTES ENTRANT’S FULL AND UNCONDITIONAL AGREEMENT TO AND
ACCEPTANCE OF THESE OFFICIAL RULES.

I. CONTEST PERIOD: The “The American Energy Comfort Give-a-way” Contest (the “Contest”) begins on or about 12:00:01 p.m. Pacific Standard Time (“PST”) on Monday, November 20, 2023 (“Start Date”) and ends at 11:59:59 p.m. PST on Friday, December 22, 2023 (the “Entry Period”). The official clock for purposes of the Contest is the computer of the Sponsor.

II. SPONSOR: American Energy Air, 6301 Angelo Ct. Ste 1, Loomis, CA 95650

III. ELIGIBILITY: The Contest is open to permanent legal US residents in the Greater Sacramento Area and within the service area of American Energy. Entrants must be a homeowner of a single-family home. To participate in the Contest, the Entrant must have Internet access and submit their entry through the website: www.TheAEWay.com. They must agree to fill out the entry form completely and submit the required photos of their current HVAC system for evaluation from American Energy.

Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

IV. HOW TO ENTER THE CONTEST: During the Entry Period, an Entrant can enter the Contest by filling out the online entry form and submitting photos of their current HVAC system along with all required information per these Official Rules through www.TheAEWay.com.

V. The following information will be required to be included: i) First and last name, residential address, and phone number, and ii) upload digital pictures of their current HVAC system. All required information must be included to enter and to be eligible to win. Incomplete Submissions will be disqualified.

Limit one (1) entry per person during the Entry Period. All entries must be received by 11:59:59 p.m. PST on December 22, 2023.

Sponsor reserves the right to disqualify any person or email address that submits more than the maximum number of Submissions or does not submit proper verification of residency in the American Energy service area. The sponsor will be reviewing all Submissions.

VI. HOME COMPATIBILITY AND SYSTEM REQUIREMENTS: By completing a Submission, the Entrant: (i) warrants and represents that he/she has read these Official Rules, is eligible to participate in the Contest and agrees to be bound thereby; (ii) warrants to a pre-qualification from American Energy to be reviewed for system compatibility if they are chosen as the winner (iii) consents to the use of his/her name and/or likeness by the Sponsors and its respective authorized representatives for promotional purposes in connection with the Contest (whether online, in print or through any other media now known or hereafter developed), without additional compensation and unless prohibited by law; and (iv) agrees that, if selected as a prize winner, Entrant will be solely responsible for any and all resulting tax consequences.

VII. VI. USE OF PERSONAL INFORMATION/OPT-IN: By entering online at www.TheAEWay.com, you consent for the Sponsor to obtain, use, and transfer your name, address, and other information for the purpose of administering this Contest; the information that you provide in connection with the entry process will be used by Sponsor only, and will not be sold or provided to another company. Entrant authorizes the Sponsor to send emails to the address entered on the registration form, regarding product offerings; provided, however, the Entrant may opt out of receiving future emails from the Sponsor by clicking on the link contained in any email received. Eligibility to participate in the Contest is not dependent upon Entrant’s consent to receive such emails and consenting to receive such emails will not impact any Entrant’s chances of winning. Entrant will remain eligible for this Sweepstakes whether or not he/she opts out of receiving the emails.

Entrant authorizes American Energy Heat & Air and a camera crew to surprise the chosen winner on or around December 23rd at their submitted address. 

VIII. VII. PRIZE: There will be one (1) Grand prize available to be awarded. The Grand Prize winner will receive a Whole Home HVAC System. The Approximate Retail Value (“ARV”) of the Grand Prize is $13,000. The exact make and model of the HVAC System will be determined by the Sponsor after evaluating the winner’s current home system configuration.

IX. VIII. CONTEST WINNER DETERMINATION: The Grand Prize Winner will be determined by the Sponsor on or about December 23, 2022. The potential Prize Winner is subject to verification, including without limitation, verification of eligibility, compliance with these Official Rules, and completion of release form. Entrant authorizes American Energy Heat & Air and a camera crew to surprise the chosen winner on or around December 23rd at their submitted address.

All contestants who do not win will receive a complimentary System Tune-up for participating.

X. PRIZE NOTIFICATION, TERMS, AND CONDITIONS: The Prize Winner is required to comply with any and all applicable federal, state, and local laws, rules, and regulations. The value of any prize awarded to the Prize Winner will be reported for tax purposes as required by law. The Prize Winner will be required to provide the Sponsor with a valid social security number (as the ARV of the respective prize be equal to or greater than $600) before a prize will be awarded for tax reporting purposes. An IRS Form 1099 will be issued in the name of the Prize Winner for the total ARV of the Prize, as stated above, in the calendar year the prize was won.
